Please read the attached “Additional Terms and Conditions” for details on cleaning and damage deposit and charges to credit card.

Guest also authorizes Owner to charge additional amounts to Guest's credit card for smoking, pets, damage, repairs, theft and excess cleaning.

Prohibited: Pets. Guest shall not keep pets or animals on the premises. Violation will be grounds for immediate eviction. The presence of any pets will subject the Guest to a cleaning surcharge of $500 to be charged to Guest’s credit card.

Prohibited: Smoking. Smoking within the home is prohibited. Violation will be grounds for immediate eviction. Any smoking in the home = $500 cleaning charge.

Clean-up at Check-out. Property to be left clean at time of check-out. Trash to be bagged and placed in dumpster. All personal items to be removed from Property.

Cancelation. In the event Guest requests cancellation of Agreement, Owner will attempt to re-rent the property. If Property is re-rented for amount of rents, the Deposit will be refunded, subject to a cancelation fee equal to 10% of total rent. If the Property is not re-rented to a third party, then the Guest will remain responsible for the rental amount as described on the attached page. No refunds for inclement weather, or other circumstances beyond the control of the Owner.

Late Check-out = $100.00 per hour (or portion thereof) after 10:00 a.m. - to be approved in advance by Owner

This Agreement is not effective until the Deposit is received by Owner. If not received within 10 days of the date the reservation is made, Guest’s reservation will be canceled. Reservations made within 60 days of arrival must be paid in full (including cleaning/damage deposit) at time of booking. By signing below, the Guest(s) confirm(s) that this Agreement includes this page as well as the attached “Additional Terms and Conditions,” that Guest has read and understands this agreement and will abide by the terms hereof, including and all rules and regulations of the Property. The Additional Terms and Conditions, rules and regulations and any other details for rental of the Property can be found at faithfulstreetinn.com under the “policies” link. By signing/approving this Agreement, Guest(s) authorize Owner to charge Guest(s) credit card(s) for all charges due hereunder including rents, damages, repairs, cleaning and theft.

Faithful Street Inn, L.L.C. - Vacation Rental Agreement - Additional Terms and Conditions

1. Rent & Deposit. Owner requires that Guests provide a Reservation Deposit equal to ½ of the total rent including tax and cleaning fees. The balance of the rent is due 60 days before the check-in date.

2. Cancelation Policies. A. More than 60 days before Arrival Date. If Guest cancels more than 60 days before the Arrival Date, Guest will be entitled to a full refund of all deposits, less a cancelation fee of 10% of the total rents.
B. Within 60 days of the Arrival Date. If, for any reason, the Guest cancels within sixty (60) days of the Arrival Date, the entire amount of the Rent is still due and will be retained by Owner as liquidated damages. However, if the Owner is able to re-rent the Property under the same (or better) terms and conditions than this Agreement, Owner will refund any rents and deposits paid, less a Cancellation Fee of 10% of the total rent. If the Property is rented for an amount less than the total rent, Guest will be responsible for and Owner will retain the difference between the total rent and the amount that Owner received from a substitute renter.
C. Guest’s Failure to Pay Final Payment No Later Than 60 Days of Arrival. Failure to pay the Final Payment in a timely manner on or before 60 days before the Date of Arrival, will be considered a cancellation of the Agreement by Guest and will authorize the Owner to retain the Reservation Deposit as liquidated damages.

3. Payment for Damage, Repairs, Cleaning and Theft -- Smoking and Pets. In the event of (a) damage to the property, furniture, appliances, (b) excess cleaning required as a result of Guest’s failure to clean the property, or (c) theft of Owner’s property, Guest expressly authorizes Owner to charge expenses associated with damage, repairs, cleaning and theft to Guest’s credit card. The amounts charged will be the actual expense incurred by Owner, plus an administration charge of 10% of the total cost. In the event of smoking while in the property, Guest agrees to a minimum $500 cleaning charge. In the event Guest brings a pet into the property, Guest agrees to a minimum $500 cleaning charge. Guest agrees that these minimum charges of $500.00 for smoking or pets are reasonable due to the considerable additional effort Owner must take to clean the property, bring it to a ready-to rent condition and remove any traces of smoking or pets. Owner will notify Guest of any such charges within 5 days of check-out.

4. Amenities. There is no air conditioning in the Property. Please bring your cell phone and charger. Owner provides limited amenities such as cable television, wi-fi internet access and small appliances. These amenities should be in working order at the time of your arrival. Please report any inoperative equipment to our office promptly. Owner will make every reasonable effort to have repairs made as soon as possible. Please remember that there are limited service contractors in the West Yellowstone area and repairs and maintenance cannot be guaranteed. You are not entitled to any refund for the condition of small appliances, cable television, internet service, etc.

5. Other Prohibitions. The use/presence of recreational motor vehicles that provide sleeping accommodations such as travel/camp trailers or motor homes is prohibited. The use of fireworks on the Property or in any common areas is prohibited. Open fires are prohibited within the city limits of West Yellowstone. No smoking is allowed within any home or cabin -- Smoking outside only.

6. Responsible Guests - Age Requirements - Occupancy Limits. All rentals are to Guest(s), families and responsible adults over the age of 25. Guest acknowledges that he/she will not assign this Agreement or sublet any portion of the Property. Occupancy is restricted to the maximum occupancy (including children) described on page 1. Property shall not be used for any illegal or unlawful purpose. Use of the Property and/or common areas contrary to the provisions of this paragraph or that disturbs or offends other guests or residents shall be deemed grounds for immediate termination, eviction and forfeiture of all rents and deposits.

7. Care of Property - Repair and Maintenance - Owner Right of Entry. Guest is responsible for any damage to the Premises or its contents, normal wear and tear is excepted. Guest is expected to care for the Unit as if it were his or her own and must comply with all rules and regulations at the Property and in all common areas. Guest acknowledges that unless Owner is notified on day of check-in of any damage or cleaning concerns, all damages or concerns to the Unit during the occupancy will be Guest’s responsibility and must be reported to Owner and paid by Guest prior to departure. Guest must leave the Unit in a clean condition to include the following: keys to be left on kitchen table or returned to office; all trash to be bagged & placed in trash containers; all dirty dishes put into dishwasher and started; wipe down all counters and cooking surfaces; entry doors locked and windows closed and locked; and all loss and breakage reported to Owner. Failure to comply will give Owner the right to charge Guest’s credit card for cleaning, damage, theft, etc. Owner may enter the Property at any time to investigate disturbances, check occupancy, check for damage, and make repairs or improvements as Owner deems necessary or appropriate.

8. Waiver of Liability - Indemnity. The Guest(s), for himself/herself, his/her heirs, assignors, executors and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature that may occur to the Guest(s), or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from.

9. Weather - Acts of God. The weather in the Yellowstone area is unpredictable. There shall be no refunds due to weather conditions or other circumstances or acts of God over which Owner has no control.

10. Property Left Behind. Valuable items left behind by Guest will be held for the Guest and a reasonable effort will be made to contact the Guest for return. If items are not claimed by Guest within 7 days from the end of the rental period shall become the property of the Owner, and Owner shall be entitled to dispose of such property as it deems appropriate. The Owner shall not be liable for condition of said items.

11. Miscellaneous. Time is of the essence. All prior agreements between Owner and Guest are incorporated in this Agreement, which constitutes the entire contract. It is intended as a final expression of the parties’ agreement, and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. The parties further intend that this Agreement constitutes the complete and exclusive statement of its terms, and that no extrinsic evidence whatsoever may be introduced in any judicial or other proceeding, if any, involving this Agreement. Any provision of this Agreement that is held to be invalid shall not affect the validity or enforceability of any other provision in this Agreement. The waiver of any breach shall not be construed as a continuing waver of the same or any subsequent breach. This Agreement shall be governed and construed in accordance with the laws of the State of Montana. The 18th Judicial District Court located in Bozeman, Gallatin County Montana shall have personal jurisdiction over the parties and shall be the exclusive forum for any legal action brought in relation to this Agreement. The prevailing party in any action to enforce this agreement shall be awarded its costs and attorneys fees.
